# Terms of use

OlaSail is free to read as a planning guide, never for navigation. If you send us a report or a photo, it must be your own first-hand account, and you let us publish it with credit.

These terms say how you may use the site, what you may send us, how we check and moderate it, how to report something illegal, and how to appeal a decision.

Effective 7 Oct 2026. Written by [Domagoj Franc](https://olasail.com/about/people/domagoj-franc/)

## Introduction

These terms are the rules for using OlaSail, a guide to sailing in Croatia at olasail.com, and for sending us reports, photos and emails. The site is published by Zukunft d.o.o., Grožnjanska ulica 32, 10000 Zagreb, Croatia, which we call "we" in these terms.

By using the site, you agree to these terms. Our [privacy policy](https://olasail.com/privacy/) says what we do with your data, and our [photo licence](https://olasail.com/about/photos/) covers the photos on the site. If you don't agree with these terms, please don't send us anything.

## Definitions

- The site: olasail.com and all its pages.
- We: The publisher of the site, and the people who write and check it.
- You: Anyone who reads the site or sends us something.
- A report: Anything you send us: a report of a change, a "Still right?" tap, a photo or an email.
- An editor: A person who checks facts with their sources and reads the reports sailors send.
- The operator: The business that runs a place: a marina, a buoy field, a town quay or a restaurant.

## A planning guide, never for navigation

OlaSail helps you plan a sailing trip. It is not a navigation source. Our maps, route lines, distances and depths are for planning only. On board, use official charts, notices to mariners and the official marine forecast, and your own judgment as the skipper.

Every fact that changes shows its source and the date we checked it. Prices, rules and conditions can change between checks. Look at the date, and check with the operator or the official source before you rely on a fact.

Nothing on the site is legal, weather or navigation advice. The emergency numbers and the official sources to use at sea are on [Safety and limits](https://olasail.com/about/safety/).

## What you can send us

- A report of a change A price, a rule or a service that is different from what our page says. Use [Report a change](https://olasail.com/about/corrections/).
- A "Still right?" tap A tap on a fact's source marker that says you saw it too. It never changes a fact or its date.
- A photo A dated photo of a price board, a notice or the buoys helps us most.
- An email A question, a correction or a notice about something illegal.
- An area steward's checks If you look after an area for a season. See [Become an area steward](https://olasail.com/about/contribute/#steward).

You don't need an account. Nobody is paid for a report, and we never accept a free berth or meal for a check.

## The rules for what you send

- First-hand only Send what you saw yourself, what the operator told you, or what you read on an official notice, and say which. Don't copy from apps, other guides or directories.
- No ads Don't promote a business, and don't send the same report again and again. A report written like an advert is not shown.
- Say if you have ties If you work for, own, or have family in a business at or near the place, tell us. We then check what you say with you directly, as the operator. If we find a tie you didn't tell us about, we take your reports off the site.
- No accusations Tell us what you saw, with the date. We don't publish claims of crime or fraud, or attacks on a named person. For a crime or a danger at sea, call the harbourmaster or the police.
- Keep other people out of it No names of staff or other crews. We blur faces, boat names and registrations in photos.
- Only your own photos, and nothing illegal Send only photos you took yourself. Send nothing that breaks the law or someone else's rights, such as copyright or privacy.
- No tricks No fake "Still right?" taps, no reports sent by a program, and no attempts to reach parts of the site that aren't public.

## The licence you give us

What you send stays yours. You give us the right to use it, as below, and you tell us you have the right to give it.

### Your words

- You let us use them You give us a free, non-exclusive licence, anywhere in the world, to store, check, edit, shorten, translate and publish what you wrote, on the site and in our own reports, like a season review.
- A checked fact is ours When we check your report with the source, we publish the fact in our own words, resting on that source. It stays if you take your report back.
- We say how we quote you In "What sailors told us" your words are marked "As sent", "Shortened" or "In our words", with the date.
- You can take them back Ask us, and we take your quoted words off the page within 7 days.

### Your photos

- You keep the copyright You can use your photo anywhere else.
- You let us publish it On the site and in our own reports, for free, for as long as the page is up. You tell us you took it yourself.
- We credit you as you ask By your first name and initial, or "Photo: a sailor". We may crop it, correct the light, blur faces, boat names and registrations, and remove the location data.
- You can take it back Ask us, and we take it off the page within 7 days. The full terms for photos are on the [photo licence](https://olasail.com/about/photos/#sailors).

## How we moderate what you send

Every report is read by a person. We use no automated tools to decide what goes on a page or what comes off it.

- A person reads everything An editor reads every report, photo and email. A report about safety goes first.
- A report never changes a fact on its own We check it with the source responsible for that kind of fact: the operator for prices and hours, the official text for rules and fees, and a skipper reviewer for shelter, depth and hazards. [How we check facts](https://olasail.com/about/how-we-check/)
- What we may do with a report Use it to check a fact, show it in "What sailors told us" with its date, shorten it, or not publish it. Most reports never appear as sent: they start a check.
- When we take something down If something we published from a report breaks these terms or the law, or is out of date.
- If someone keeps breaking the rules We may stop taking their reports and take their earlier ones off the site.
- A danger to someone's life or safety If a report tells us that a person's life or safety is at risk, we tell the police at once. We are not an emergency service: at sea, use the numbers on [Safety and limits](https://olasail.com/about/safety/#emergency).
- Fair and in proportion We apply these rules with care, fairly and in proportion, and we respect your right to say what you saw.

## Report illegal content

If you think something on our site is illegal, tell us. For example, a photo of yours that we used without your permission, a photo that shows you, or words that harm someone's good name. For a fact that is simply wrong, use [Report a change](https://olasail.com/about/corrections/) instead.

Write to us, or use Report a change, and include:

1. 1

What it is, and why it is illegal

Explain what breaks the law, and which law if you know it.
2. 2

   Where it is

The exact page address, and where on the page.
3. 3

   Your name and email

So we can confirm we got it and tell you what we decided. Without them we can still act, but we can't reply.
4. 4

That you believe it is true

A line that says what you told us is accurate and complete, as far as you know.

We confirm we got your notice without delay. A person decides, with care and without bias, and tells you what we decided and how you can challenge it. We may take a photo down while we check.

## When we remove or restrict something you sent

If we take down, hide or shorten something you sent, or stop taking your reports, we tell you why. Under the Digital Services Act, every hosting service must tell people when it removes or restricts what they posted, and explain why, with the rule or the law it relied on. (Official source, 26 Sep 2026) We can write to you only if you left your email.

Our message follows the EU's [Digital Services Act](https://eur-lex.europa.eu/eli/reg/2022/2065/oj/eng), and says:

- What we did What we removed or limited, where, and for how long.
- Why The facts behind it, and whether it followed someone's notice or our own check.
- The ground The rule in these terms, or the law, that it rests on, and why it breaks it.
- How to challenge it How to appeal to us, and where else you can go.

## How to appeal

1. 1

   Reply in time

Reply to our message, or write to us, within 6 months of our decision. Say what you think we got wrong.
2. 2

   Another person looks again

Someone who didn't make the first decision looks at it again, where we can.
3. 3

   We tell you the result

What we decided and why. If we got it wrong, we put it back.
4. 4

   You can also go elsewhere

You can complain to the Digital Services Coordinator in the country where you live. Croatia's Digital Services Coordinator is HAKOM, the Croatian Regulatory Authority for Network Industries. (Official source, 26 Sep 2026) You can also go to court.

The same steps apply if you sent us a notice and disagree with what we decided.

## How old you must be to send us anything

You can read the site at any age. To send us anything, such as a report, a photo or an email, to become an area steward, or to allow analytics, you must be 16 or older. In Croatia a child can agree to an online service on their own from the age of 16. (Official source, 26 Sep 2026)

## Our own content

Our text, tables, route lines and maps are our own work, unless a credit says otherwise. Photos keep their own licences, shown with each one; see the [photo licence](https://olasail.com/about/photos/). Map data comes from OpenStreetMap contributors, under the Open Database License.

You may quote a short part of a page with a link to it. Ask us before you copy more, and don't copy our records into another guide, app or directory.

## Links to other sites

We link to official sources, operators and other sites so you can check a fact for yourself. We don't run those sites and can't answer for what they say or do. Their own terms apply once you follow a link.

## No guarantees, and our liability

- Free, and as it is We check every fact with its source and show the date, but we can't promise that every fact is still right on the day you read it, or that the site is always up.
- What we are not liable for Loss or damage from relying on the site: a fee that went up, a bay that was full, a berth that closed, or a decision made at sea. Or anything on another site we link to.
- What we can't limit Under Croatian law, a contract can't exclude or limit in advance the liability for harm caused on purpose or through gross negligence. (Official source, 26 Sep 2026) Nothing in these terms takes away a right the law gives you as a consumer.

## Governing law

Croatian law applies to these terms. A dispute goes to the court with jurisdiction where we are based, in Zagreb. If you use the site as a consumer, you may also go to the courts where you live, and we can take you to court only there. If you live in another country, you also keep the protection its law gives you as a consumer.

If one part of these terms turns out to be invalid, the rest still applies.

## Changes to these terms

1. 7 Oct 2026 First version.

When these terms change, we list the change here first, with its date, and change "Last updated" at the top. For a big change, we also say so on the site before it applies. We may change or stop parts of the site at any time.

## Contact us and our contact points

One address for everyone. A person reads every message, never a chatbot, and we answer in English or Croatian.
